Danish supplier of mining equipment and technology to the cement industry, FLSmidth, issued a statement on Friday announcing the commencement of an investigation into possible sanctions violations. The reason for this was the discovery that the company had transferred certain pre-contractual tender materials to Russia.
In a statement, the company said that during the course of an ongoing internal investigation, it was established that FLSmidth transferred materials to persons located in Russia in connection with a limited number of potential projects in Kazakhstan.
The company added that it has stopped participating in these tenders.
When asked what sanctions FLSmidth may have violated, the company said in a written comment that it notified both the US and Danish authorities about the incident.
"As the investigation is still ongoing, the information we can share at this stage is set out in our press release," the company said.
The United States and the European Union imposed sweeping sanctions against Russia after it launched a full-scale invasion of Ukraine in 2022.
As noted by FLSmidth, the tender activity in question - carried out in the period up to 2026 - could potentially qualify as the provision of services subject to applicable sanctions rules, and may also contradict the company's internal procedures.
According to the company's information (based on the preliminary results of the investigation), tender materials were provided at the stage of preparing commercial proposals - that is, before concluding any contracts for the implementation of the projects themselves.
FLSmidth said it is notifying the relevant government authorities, including the U.S. Treasury Department's Office of Foreign Assets Control (OFAC) and the Danish Business Administration, about the incident and expressed its willingness to cooperate with authorities as the internal investigation progresses.
The company also said it is currently reviewing and enhancing its compliance program and risk management measures and taking other measures to minimize the impact of the incident.
